The Importance of Keeping your Beauty Business Legal – Part 2
What Types of Licenses are Generally Needed
This varies from place to place, but there are some general guidelines. It is important to note thought that the following lists are general and there may be other types of license necessary.
Business Licenses: These are required just about everywhere. The issuer is usually determined by your location. So if you have a business in a city, the city handles it and if you are outside of a city, whatever town you re located or the county you are located handle operating licenses.
Property Use Permits: These apply to home-based businesses that involve manufacturing or use of a home as the headquarters of a business and are subjective to the amount of local regulations in the town or city your business is located.
Building Permits: Construction, expansion or renovation usually require a permit. They also usually require a visit to answer questions form your local zoning board. The degree you need them depends on the local zoning laws.
Certificates of Occupancy: All new businesses occupying a building for the first time have to apply for this form a city or county zoning department.
Health Department Permits: Businesses that involve the preparations, handling or dispensing of food have to have these permits and they usually also have to have a Certificate Health Inspection. Some states require that any business that sells food also have an employee who is certified in food preparation and storage be on the premises at all times.
Specific Product Licenses: Certain products, usually products that can cause harm if not used properly and products that can be easily manipulated to cause crime, require licenses or permits. Examples include HAZMAT handling, firearms, fireworks, gasoline, firearms and in the latter case lottery tickets. Lottery ticket sellers are licensed as they have to go through a background check to verify that they have no felony convictions or other convictions involving theft, illegal taking, embezzlement or racketeering.
Professional Licenses: These licenses apply for professional services that specialize in specific technical products or require a high degree of specific skills to complete. Legal, medical, cosmetology, auto repair, masonry and construction jobs are examples of these types of professions – this includes many aspects of the beauty and spa industries. Often, to obtain the licenses, the applicant has to show specific training in their selected field.
Employer Identification Number: This is the identity of your beauty business for federal tax and identification purposes. Also, many states require the same number or a similar number for tax purposes.
Sales Tax Licenses and Numbers: Every state has at least one form of sales tax and the sales tax number is required for every business before they open for business. The number is used for identification and usually also includes instruction on levying sales tax, reporting and payment requirements to the state and can be obtained from either the State Treasury Department or the Department of Revenue.
